The Czech National Council has resolved on the following law:

Part One 

Introductory provisions 

§ 1

            (1) The Office for Technical Standardisation, Metrology and State Testing (hereinafter referred to as "the Office") is hereby established as an administrative office with its seat in Prague, which is subordinate to the Ministry of Industry and Trade (hereinafter referred to as "the Ministry"). The Office is an accounting unit.

(2) The Office shall be headed by a Chairman; his selection, appointment and dismissal shall be governed by the Civil Service Act.

 

§ 2

            State administration bodies in the field of technical standardisation, metrology and state testing are

(a) the Ministry,

(b) The Authority.

Part Two 

Competence of state administration bodies in the field of technical standardisation, metrology and state testing

 § 3

            Ministry of Technical Standardisation, Metrology and State Testing

(a) draw up a proposal for the development of the sector,

b) shall be managed by the Office and the Czech Metrology Institute,

(c) decide on appeals against decisions of the Office.)

 

§ 4

            Office for Technical Standardisation, Metrology and State Testing

(a) manage and ensure metrology to the extent provided for by special legislation, 3)

b) ensure the uniformity and correctness of the established gauges and measurements and the performance of state metrology to the extent provided by law, 3)

(c) decide on appeals against decisions of metrological bodies, 7)

d) ensure the organisation of the preparation of the adoption of the European Community technical regulations adopted by the Government Regulations,

e) contractually secures tasks arising from international treaties by which the Czech Republic is bound and tasks arising from the requirements of ministries and other central administrative authorities.

Part Three 

Transitional and final provisions 

§ 7

            (1) Decrees and assessments relating to specified measuring instruments and products subject to approval or compulsory certification issued by the Federal Office for Standardization and Measurement under existing regulations shall remain in force.

(2) If an organisation with its registered office in the Slovak Republic is listed as a state testing laboratory in the returns or assessments under subsection (1), an application for approval or compulsory certification shall be submitted to the Office.

§ 8

            (1) Technical standards issued before the entry into force of this Act under the existing regulations shall remain in force.

(2) Czechoslovak technical standards shall be considered Czech technical standards from the date of entry into force of this Act; the letter mark "ČSN" shall not be changed.

§ 9

            Certificates of authorization and accreditation 11) issued by the Federal Office for Standardization and Measurement under the existing regulations to entities based in the Czech Republic remain valid.

§ 10

            Administrative acts issued under the legislation on metrology and state testing before the entry into force of this Act shall remain in force.

§ 11

            This Act shall enter into force on 1 January 1993.
