New legislative framework

New legislative framework for the marketing of products

The new legislative framework for the marketing of products came into force on 1 January 2010. It is designed to improve the functioning of the internal market for goods, with the main aim of ensuring the safety of citizens and reducing the number of products on the market that do not comply with European legislation. Another objective is to improve the quality of the work carried out by bodies active in product testing and certification. The framework will also bring greater consistency to the whole regulatory framework for products, and simplify its application.

Corrigendum to Decision No 768/2008/EC of the European Parliament and of the Council of 9 July 2008 on a common framework for the marketing of products and repealing Council Decision 93/465/EEC

Corrigendum to Regulation (EC) No 765/2008 of the European Parliament and of the Council of 9 July 2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products and repealing Regulation (EEC) No 339/93

Regulation (EU) 2019/515 of the European Parliament and of the Council of 19 March 2019 on the mutual recognition of goods lawfully marketed in another Member State and repealing Regulation (EC) No 764/2008 (effective from 19 April 2020)

On 29 March 2014, the following was published in the Official Journal of the EU, Volume L 96 eight directives that respect the principles of the New Legislative Framework.

On 22 May 2014, the following was published in Official Journal of the EU, Volume L 153 Guidelines 2014/53/EU of the EUROPEAN PARLIAMENT AND OF THE COUNCIL of 16 April 2014 on the harmonisation of the laws of the Member States relating to the making available on the market of radio equipment and repealing Directive 1999/5/EC (PDF 559). 

 

On 31 March 2016, the following was published in Volume 36 of the Collection of Laws Act No. 90/2016 Coll., on conformity assessment of specified products when they are placed on the market /PDF 663 kB/ . This Act shall enter into force on the fifteenth day after the date of its promulgation, except for the provisions of Section 47(2), which shall enter into force on 12 June 2018.

On 31 March 2016, the following was published in Part 39 of the Collection of Laws Government Regulation No. 96/2016 Coll., on recreational craft and jet skis /PDF 1,8 MB/. This Regulation shall enter into force on the fifteenth day after its promulgation, i.e. on 15 April 2016.

On 6 April 2016, in volume 40 of the Collection of Laws, the following was published Government Regulation No. 97/2016 Coll., on technical requirements for explosives /PDF 2,5 MB/. This Regulation shall enter into force on 20 April 2016, with the exception of Section 11, which shall enter into force on the fifteenth day after its promulgation.

On 18 April 2016, the

Decree Part 45 of the Collection of Laws /PDF 4,1 MB/published:

  • Government Regulation No. 116/2016 Coll., on conformity assessment of equipment and protective systems intended for use in potentially explosive atmospheres when they are placed on the market
  • Government Regulation No. 117/2016 Coll., on the assessment of the conformity of products with regard to electromagnetic compatibility when they are placed on the market
  • Government Regulation No 118/2016 Coll., on the assessment of conformity of electrical equipment intended for use within certain voltage limits when placed on the market
  • Government Regulation No. 119/2016 Coll., on conformity assessment of simple pressure vessels when they are placed on the market

Decree Part 46 of the Collection of Laws /PDF 5,7 MB/ published:

  • Government Regulation No. 120/2016 Coll., on conformity assessment of measuring instruments when they are placed on the market

Decree Part 47 of the Collection of Laws /PDF 4,5 MB/ published

  • Government Regulation No. 121/2016 Coll., on conformity assessment of scales with non-automatic operation when they are placed on the market
  • Government Regulation No. 122/2016 Coll., on conformity assessment of lifts and their safety components

These Regulations shall enter into force on 20 April 2016.

 

On 18 July 2016, in Part 85 of the Collection of Laws, the following was published Government Regulation No. 219/2016 Coll., on conformity assessment of pressure equipment when placed on the market /PDF 6,1 MB/. This Regulation shall enter into force on 19 July 2016.

 

On 26 October 2016, Government Decree No. 345/2016 Coll. on marine equipment /PDF 1,98 MB/. This Regulation shall enter into force on 10 November 2016.

On 23 December 2016, Government Decree No. 426/2016 Coll.,., on conformity assessment of radio equipment when placed on the market, as amended by Government Regulation No. 499/2021 Coll..

On 26 July 2016, it was published in the Official Journal of the EU, C 272: Communication from the EU Commission - "Blue Guide" on the implementation of EU product rules 2016. /2.36 MB/

The provisions of the Directives are adapted to a model developed at EU level to overcome the divergences in EU law that make life difficult for traders. Producers, importers and distributors will benefit from uniform trading conditions. Product safety on the EU market will also be improved by strengthening the procedures for demonstrating conformity and by making it easier not to allow non-compliant products on the market.

The changes concern definitions (e.g. manufacturer, placing on the market, CE marking), obligations of economic operators, traceability requirements, conformity assessment bodies and procedures, CE marking, etc.
